Pressure ulcers have long been an issue for patients immobilized for lengthy periods of time. Although in recent years there has been a greater emphasis and awareness regarding prevention of pressure ulcers, starting in October health care professionals will be held financially responsible for patients who develop them.

What are Never Events?

Never events can be defined as events that should not occur, or preventable adverse events. Along with a long laundry list of circumstances and events such as performing the wrong surgery and blood incompatibility errors, pressure ulcers that develop in patients during the course of their hospital stay will no longer be reimbursed, as set forth in the CMS (Centers for Medicare and Medicaid Services).

Why are pressure ulcers being classified as Never Events?

Pressure ulcers are increasing in hospitalized patients, and patients hospitalized specifically for treatment of pressure ulcers have a higher than average length of stay. They can lead to extended lengths of stay, infection, pain, loss of function, and even death. As well, the cost of treating pressure ulcers is approximately $11 billion per year.

What does the new ruling mean for healthcare professionals and their employers

Essentially, the CMS ruling means that if a patient is admitted to the hospital without a pressure ulcer, and subsequently develops a pressure ulcer, the hospital will not be paid for that patient's care.

What effect will this new ruling have on hospitals, long-term care, and home health care?

Obviously, hospitals that have a high incidence rate of development of pressure ulcers will stand to lose a great deal of money; this could greatly impact the financial viability and well-being of the hospital and, by extension, the hospital staff. Considering that the cost of treating a pressure ulcer can be as much as $70,000.00, the need to take steps to prevent ulcers aggressively needs to start now. Facilities that have a program in place to identify and treat patients at risk for the development of pressure ulcers will fare better than those who don't.

There are some facilities that are exempt from the CMS ruling. These include critical access hospitals, long-term care hospitals, Maryland waiver hospitals, hospitals that treat only cancer, and children's inpatient hospitals.

You may be wondering how home care will fare under this new ruling. The implications are ominous for home health care practitioners and their employers. There is no provision under the new CMS ruling that states that pressure ulcers must be healed before patients leave the hospital. This means that home care will then bear the financial responsibility for pressure wounds in patients discharged home with pressure ulcers. Additionally, a difficulty that has been identified in the home care setting is the issue of the healthcare provider's inability to control the patient and the patient's family in terms of compliance with wound care prevention and treatment recommendations. This is very important in terms of performance monitoring and risk management.

What can healthcare professionals do to ensure they are prepared to meet the challenges of the new guidelines?

Prevention, accurate assessment, and documentation of wounds will become even more crucial as of October of 2008. The IHI (Institute for Healthcare Improvement) recommends six steps in the prevention of pressure ulcers:

Assess the skin of all patients upon admission for existing ulcers, and identify those at risk of developing ulcers (i.e. Braden scale)
Reassess the entire skin daily, observing for development of pressure ulcers or worsening of pre-existing ulcers
Assess the patient's risk factors for pressure ulcers daily
Manage moisture properly
Optimize the patient's nutrition and hydration status
Minimize pressure and use pressure minimizing tools properly

1- Keep to the Speed Limit Especially when Passing Through School Zones

Pay close attention to signs. Sometimes the speed limit will be 80 kilometers per hour then suddenly drop to 25 kilometers when approaching a school.

2 - Watch for Passing Vehicles

Ticos are never in hurry until they get behind the wheel of a car. Someone will always try to pass you on the open road. It's best to move over a little to the right and let them pass. Tis the Season for Holiday Burglary: 6 Things Burglars Love and Hate to See

Every year, law enforcement agencies warn of increased crime during the holidays, and rightfully so! The FBI reports that nearly 400,000 burglaries occur during November and December alone. Of those 400,000, single family homes are the most frequent victims. Did you know that 70% of burglars are amateurs, just looking for easy targets?

As a former law enforcement officer and now a security professional, I have frequently encountered victims of burglary. These people are determined to not let this happen again and quickly get on the right track, with the right gear and practices. A message that they gladly share, is to be prepared ahead of time.

Being prepared will at least give you peace of mind that your family, home, and property that you've worked so hard for is safe and sound. Should a burglar hit your home, you'll have the means to help get the bad guy what he truly deserves.

Even with my background, my home is not immune from burglary. Two years ago, during the holiday season, my neighborhood experienced a rash of burglaries, theft, and my house was included. One crook decided he deserved my son's Christmas present (bike) more than my son.

Fortunately, my house was equipped with video cameras and the details obtained from the video allowed for the quick detention of the crook. Since that day, there has not been a single incident in the neighborhood and the thief now has a new, permanent residence far, far away.

To make sure you and your home don't make the next crime report, let's look at what burglars are looking for and how to improve security for the holidays and all year long.

1. Advertising

Most burglars are creatures of opportunity, trolling for homes that show opportunities for easy rewards.

What they love:

Christmas tree lights
Gift boxes in the trash
Notes on the door, "I'll be home at 3"
Valuables seen through windows such as laptops, televisions, game consoles, etc.
Social media postings, "Heading out for the holidays!"
Over-stuffed mailboxes
Garbage cans left on the street

What they hate:

Concealment

As far as your valuables are concerned, remember that if it caught your eye at the store, it will catch the crook's eye as well. Conceal rather than advertise -- they hate that. Make sure this approach extends to your yard too. Tools, toys, electrical equipment, and supplies should all be tucked away. Secrecy

For yourself, it is very true that people you know may be scoping you as a potential target, so only advertise your vacation when you come back -- you'll have great pictures and stories to tell then anyhow.

Stopping Deliveries

For your home, of course you should stop the mail and leave your garbage cans concealed.

Threat

Additionally, if you have some type of security system you should advertise it. Sure, there are professional burglars that laugh at security signs, but remember most are amateurs. All you need to do to make them think again is to advertise your security system. Be careful not to use the stock, faux signs as they are markers to criminals that you don't have a security system.

Video Cameras

Video cameras are also a great advertisement to burglars that your house is not the right house. Criminals don't like to be seen and they don't like evidence.

2. Easy Access: No Threat

Even rank amateurs can spot homes that make a good target for an easy entry and exit.

What they love:

Windows and doors in disrepair
Unsecured screen or storm doors
Unlocked backyard gates
Poor or no outdoor lighting
Unlocked sheds and barns
Concealment such as shrubs and fences

What they hate:

Delay

The main thing here is to make it difficult to gain entry, remembering that speed is the key ingredient for their success. For example, screen doors are a weak barrier to entry but do provide one more thing that delays access to the property, creates additional noise, and give thieves another second of pause to reconsider.

Looking out of place

Additionally, burglars prefer to look normal. So they would much rather walk through an unlocked gate than jump over -- so make them jump!

Pain

Windows are obviously likely points of entry for burglars. If you're not open to the idea of installing bars, plant thorny shrubs or bushes beneath the windows. Planting the right thing is effective, inexpensive and will look a lot better than bars. See your local nursery, they'll know exactly what you need.

Automated Attention

When adding or upgrading outdoor lighting, it's important to consider motion-activated flood lights. When triggered, the thought that someone inside the house possibly turned on the lights is intimidating. Again, this gives them pause to reconsider.

Possible Activity

The age old trick used to fool a crook of leaving the lights or television on when away is not very effective. A better solution is to use automated timers that will turn on electrical devices at predetermined time. Additionally, some of these devices can be used in conjunction with motion sensors to engage various lights and equipment when motion is detected outside.

Hidden, Locked & Tied Down

Should the crook make it inside, make valuables tough to find. Even if you have a safe, hide the safe itself and if possible, bolt it to a wall or floor. As for electronics such as laptops and televisions, there are many security devices available to help secure them and at minimum, slow the crook down.

3. Habits

Burglars love it when homeowners stick to the same routine and leave signs as to where they are.

What they love:

When homeowners come home and leave at the same time
When doors such as garage doors, are open only when someone is home

What they hate:

Varying schedules. Day one of police academy, we were taught to never keep the same routine -- change our times, areas of patrol and routes. The goal was to keep the crooks guessing when and where we would be.

With the goal of preventing crime against you, you should also have varying schedules at home. If you're a 9-to-5'er like most of us, it's hard to change that schedule. However, keep in mind that burglars often live nearby and know your car, and so a variance of minutes can make a difference. On days when you can set your own schedule, change it up in order to keep them guessing.

Unclear Habits

Beside the schedule, burglars look for habits of when doors are closed and open. For instance, a garage door routinely open when your home, is a strong indicator that you're not home when its closed. A better routine is to keep that door closed all the times. This example extends to numerous things around the house -- the key is to keep your house looking the same whether you are home or not.

4. Lack of Attention

While visiting neighborhoods, if burglars get the sense that either no one is watching or no one cares, they put it on the hot list.

What they love:

Driving slowing through the neighborhood with no one turning a head
Taking a stroll with no one every waiving or saying "hi"
Parking on a street and no one ever slowing to check them out

What they hate:

A Stare

A steady stare is a powerful tool. Crooks hate it when residents are checking them out and as a result will quickly cross that area off their target list.

Neighbors that communicate

Letting your close and trusted neighbors know when you're out is important. When they see suspicious activity, them simply turning on their yard lights, glancing at your house, saying hello, etc, can be enough to send the crook elsewhere.

Neighbors that prepare

Of course, burglars especially hate it when you've made it easy for your neighbors to help. Supplying them with a list of your and local police department phone numbers will make reporting activity effortless and fast.

5. Slow reaction time

Granted, crooks want to get in and out as fast as possible. On the other hand, when they know extra time is available, they'll certainly make use of it.

What they love:

More time to loot
More time to get away
More time to change their appearance
More time to sell the goods
Another chance to do it again

What they hate:

Clearly Addressed Homes

Homes that have their house number clearly visible both day and night make it easier for police to respond quickly. Time is precious and having responded to many calls before, it's frustrating not being able to find the right house quickly due to small or no house numbers at all. Remember, police officers are consuming lots of information rapidly so try and make it easy for them to find you.

Alarm System

A good alarm system with a siren should announce to your neighbors that something is wrong and attention is needed. Additionally, the system should have a phone or cellular connection to automatically alert authorities.

Importantly, the system should be of the highest quality to ensure there are no false alarms. Otherwise, after a few false alarms both your neighbors and police will be less inclined to help.

6. No Evidence

According to the FBI, 85% of burglaries go unsolved and I can personally attest to this having responded to many myself. Witnessing the devastation of the homeowners and finding little or no evidence, it was very frustrating not being able to help.

Routinely, the homeowners would ask "what can you do?" The response was sad but true, "I can and will submit a report." There is little comfort in a police report!

Burglars love it when:

No description of them is available
Homeowner doesn't quickly know what was stolen
Homeowner doesn't have accurate descriptions of stolen property

Burglars hate:

Security Cameras

The sight of security cameras will send most burglars the other way. They know that easy access to accurate descriptions of them could spell disaster. In law enforcement, the times when we we were happiest were when we did have a proper description, or in other words, "something to go on." I can recall times where good descriptions, incident times, direction of travel, etc, led to the apprehension of the criminal sometimes in less than 15 minutes.

Today's cameras can deliver the critical details of the crime. Additionally, today's camera systems are accessible remotely via laptops and smart phones. So no matter where you are -- work, vacation, traveling -- you can check on your house, and if need be, share the evidence with law enforcement.

Covert Cameras

It's true that covert cameras won't stop a burglar -- they can't see them! However, because they can't see them, burglars won't know to avoid them, spray paint them, or cut the power cable. So, along with using traditional cameras, a couple of covert cameras placed at likely points of approach will help ensure a positive ID.

Organization

Beyond keeping up the appearances, keeping a house organized will make it easy for you to discern what's been disturbed, what's missing and what's not. In instances where you're away, this is critical so that a a relative or trusted neighbor can easily inspect the house in your absence.

Recorded Serial Numbers, Marking and Photographs

Should the worst happen but fortunately the suspect is detained, arming police with serial numbers of the stolen property will ease confessions, return of property, and convictions. Additionally, recorded serial numbers broadcast via national databases quickly will increase the potential for law enforcement to recover the property.

As a backup for serial numbers, a great idea is to also apply unique markings to property. Proven aids include engraved names, initials written with permanent markers, and purpose-built security labels.

Take photographs of both the interior and exterior of the house. This may prove helpful to determine what's missing and what's not. As for individual items, taking photographs will certainly be appreciated by your insurance company and will help expedite the claim.

How to Make Sure Your Senior Loved Ones Are Driving

According to the Federal Highway Administration, the highest number of motor vehicle fatalities occurs for drivers over the age of 70 and drivers under the age of 20. These fatalities include both automobile accidents involving other vehicles and pedestrians being hit. As we age, all of our senses are impacted by the lack of regeneration of our cells in all parts of our body and even if a senior has not been impacted by an age-related illness or memory loss, the physical capability to respond quickly will become slower.

As an accident cannot only cause death, but perhaps emotional and financial damage, many states have passed laws which require seniors to renew their driver's license in person or take a new written exam or actual driving skills test upon renewal. What's In A Name? How To Identify The Right Childcare Provider For Your Family

When you begin your search for a childcare provider, particularly if you are using an online nanny site, you will quickly find that there are many different terms that are used within the industry, including "nanny," "babysitter," "au pair," and "home childcare provider." These terms may not always be used correctly by a childcare provider, but it is important to understand the true definitions of each and what they mean for your family.

Babysitter

A childcare provider labeling him or herself as a babysitter tends to be a young person who is available to watch children on occasion, usually in the evening or on weekends. The babysitter may also simply be someone with limited time to offer childcare services and may or may not have a great deal of experience in home childcare. The bottom line is that if a family wishes to hire an au pair as their childcare provider, it is best for them to go through the licensed au pair agencies that exist and that can handle the paperwork and the legalities of the process, rather than to find an au pair independently listing herself online.

Daycare or Home Childcare Provider

Finally, when searching an online listing site, a family may come across someone listing him or herself as a daycare provider. This means that the person is offering home childcare at his or her residence, rather than at the family's home. The most important thing to find out in considering this type of childcare provider is if the person is licensed. If he or she is not licensed, the family should walk away. An unlicensed daycare provider may offer the lowest rates, but he or she also brings the highest amount of risk. In addition, even if licensed, a daycare provider must be investigated thoroughly in terms of credibility and trustworthiness, particularly if he or she will be looking after a pre-verbal child. When dealing with this type of potential home childcare provider, not only should references be checked, but the family should also visit the daycare provider's facility - possibly multiple times - to assess the situation.

There are many advantages and disadvantages of working at home. As businesses become more and more integrated with technology, it has become much easier to work at home if you choose. Here are a few reasons that you might choose to work at home.

Firstly, you need to learn how to see your way past work-at-home scams. You do not want to spend money or give your personal information to any website if you do not trust the company. Injunctions in Federal Health Care, Securities & Bank Mortgage Fraud Cases for Attorneys & Lawyers

The health care fraud, bank/mortgage fraud and securities fraud practitioner should be aware of 18 U.S.C. ? 1345, a law which permits the federal government to file a civil action to enjoin the commission or imminent commission of a federal health care offense, bank-mortgage offense, securities offense, and other offenses under Title 18, Chapter 63. Otherwise known as the federal Fraud Injunction Statute, it also authorizes a court to freeze the assets of persons or entities who have obtained property as a result of a past or ongoing federal bank violations, health care violations, securities violations, or other covered federal offenses. This statutory authority to restrain such conduct and to freeze a defendant's assets is powerful tool in the federal government's arsenal for combating fraud. Section 1345 has not been widely used by the federal government in the past in connection with its fraud prosecution of health and hospital care, bank-mortgage and securities cases, however, when an action is filed by the government, it can have a tremendous effect on the outcome of such cases. Health and hospital care fraud lawyers, bank and mortgage fraud attorneys, and securities fraud law firms must understand that when a defendant's assets are frozen, the defendant's ability to maintain a defense can be fundamentally impaired. The white collar criminal defense attorney should advise his health and hospital care, bank-mortgage and securities clients that parallel civil injunctive proceedings can be brought by federal prosecutors simultaneously with a criminal indictment involving one of the covered offenses.

Section 1345 authorizes the U.S. Attorney General to commence a civil action in any Federal court to enjoin a person from:

? violating or about to violate 18 U.S.C. ?? 287, 1001, 1341-1351, and 371 (involving a conspiracy to defraud the United States or any agency thereof)

? committing or about to commit a banking law violation, or

? committing or about to commit a Federal health care offense.

Section 1345 further provides that the U.S. Attorney General may obtain an injunction (without bond) or restraining order prohibiting a person from alienating, withdrawing, transferring, removing, dissipating, or disposing property obtained as a result of a banking law violation, securities law violation or a federal healthcare offense or property which is traceable to such violation. The court must proceed immediately to a hearing and determination of any such action, and may enter such a restraining order or prohibition, or take such other action, as is warranted to prevent a continuing and substantial injury to the United States or to any person or class of persons for whose protection the action is brought. Generally, a proceeding under Section 1345 is governed by the Federal Rules of Civil Procedure, except when an indictment has been returned against the defendant, in which such case discovery is governed by the Federal Rules of Criminal Procedure.

The government successfully invoked Section 1345 in the federal healthcare fraud case of United States v. Bisig, et al., Civil Action No. 1:00-cv-335-JDT-WTL (S.D.In.). The case was initiated as a qui tam by a Relator, FDSI, which was a private company engaged in the detection and prosecution of false and improper billing practices involving Medicaid. FDSI was hired by the State of Indiana and given access to Indiana's Medicaid billing database. After investigating co-defendant Home Pharm, FDSI filed a qui tam action in February, 2000, pursuant to the civil False Claims Act, 31 U.S.C. ?? 3729, et seq. The government soon joined FDSI's investigation of Home Pharm and Ms. Bisig, and, in January, 2001, the United States filed an action under 18 U.S.C. ? 1345 to enjoin the ongoing criminal fraud and to freeze the assets of Home Pharm and Peggy and Philip Bisig. In 2002, an indictment was returned against Ms. Bisig and Home Pharm. In March, 2003, a superseding indictment was filed in the criminal prosecution charging Ms. Bisig and/or Home Pharm with four counts of violating 18 U.S.C. ? 1347, one count of Unlawful Payment of Kickbacks in violation of 42 U.S.C. ? 1320a-7b(b)(2)(A), and one count of mail fraud in violation of 18 U.S.C. ? 1341. The superseding indictment also asserted a criminal forfeiture allegation that certain property of Ms. Bisig and Home Pharm was subject to forfeiture to the United States pursuant to 18 U.S.C. ? 982(a)(7). Pursuant to her guilty plea agreement, Ms. Bisig agreed to forfeit various pieces of real and personal property that were acquired by her personally during her scheme, as well as the assets of Home Pharm. The United States seized about $265,000 from the injunctive action and recovered about $916,000 in property forfeited in the criminal action. The court held that the relator could participate in the proceeds of the recovered assets because the relator's rights in the forfeiture proceedings were governed by 31 U.S.C. ? 3730(c)(5), which provides that a relator maintains the "same rights" in an alternate proceeding as it would have had in the qui tam proceeding.

A key issue when Section 1345 is invoked is the scope of the assets which may be frozen. Under ? 1345(a)(2), the property or proceeds of a fraudulent federal healthcare offense, bank offense or securities offense must be "traceable to such violation" in order to be frozen. United States v. DBB, Inc., 180 F.3d 1277, 1280-1281 (11th Cir. 1999); United States v. Brown, 988 F.2d 658, 664 (6th Cir. 1993); United States v. Fang, 937 F.Supp. 1186, 1194 (D.Md. 1996) (any assets to be frozen must be traceable to the allegedly illicit activity in some way); United States v. Quadro Corp., 916 F.Supp. 613, 619 (E.D.Tex. 1996) (court may only freeze assets which the government has proven to be related to the alleged scheme). Even though the government may seek treble damages against a defendant pursuant to the civil False Claims Act, the amount of treble damages and civil monetary penalties does not determine the amount of assets which may be frozen. Again, only those proceeds which are traceable to the criminal offense may be frozen under the statute. United States v. Sriram, 147 F.Supp.2d 914 (N.D.Il. 2001).

The majority of courts have found that injunctive relief under the statute does not require the court to make a traditional balancing analysis under Rule 65 of the Federal Rules of Civil Procedure. Id. No proof of irreparable harm, inadequacy of other remedies, or balancing of interest is required because the mere fact that the statute was passed implies that violation will necessarily harm the public and should be restrained when necessary. Id. The government need only prove, by a preponderance of the evidence standard, that an offense has occurred. Id. However, other courts have balanced the traditional injunctive relief factors when faced with an action under Section 1345. United States v. Hoffman, 560 F.Supp.2d 772 (D.Minn. 2008). Those factors are (1) the threat of irreparable harm to the movant in the absence of relief, (2) the balance between that harm and the harm that the relief would cause to the other litigants, (3) the likelihood of the movant's ultimate success on the merits and (4) the public interest, and the movant bears the burden of proof concerning each factor. Id.; United States v. Williams, 476 F.Supp2d 1368 (M.D.Fl. 2007). No single factor is determinative, and the primary question is whether the balance of equities so favors the movant that justice requires the court to intervene to preserve the status quo until the merits are determined. If the threat of irreparable harm to the movant is slight when compared to likely injury to the other party, the movant carries a particularly heavy burden of showing a likelihood of success on the merits. Id.

In the Hoffman case, the government presented evidence of the following facts to the court:

? Beginning in June 2006, the Hoffman defendants created entities to purchase apartment buildings, convert them into condominiums and sell the individual condominiums for sizable profit.

? To finance the venture, the Hoffman defendants and others deceptively obtained mortgages from financial institutions and mortgage lenders in the names of third parties, and the Hoffmans directed the third party buyers to cooperating mortgage brokers to apply for mortgages.

? The subject loan applications contained multiple material false statements, including inflation of the buyers' income and bank account balances, failure to list other properties being purchased at or near the time of the current property, failure to disclose other mortgages or liabilities and false characterization of the source of down payment provided at closing.

? The Hoffman defendants used this method from January to August 2007 to purchase over 50 properties.

? Generally, the Hoffmans inherited or placed renters in the condominium units, received their rental payments and then paid the rent to third-party buyers to be applied as mortgage payments. The Hoffmans and others routinely diverted portions of such rental payments, often causing the third-party buyers to become delinquent on the mortgage payments.

? The United States believe that the amount traceable to defendants' fraudulent activities is approximately $5.5 million.

While the court recognized that the appointment of a receiver was an extraordinary remedy, the court determined that it was appropriate at the time. The Hoffman court found that there was a complex financial structure which involved straw buyers and a possible legitimate business coexisting with fraudulent schemes and that a neutral party was necessary to administer the properties due to the potential for rent skimming and foreclosures.

Like other injunctions, the defendant subject to an injunction under Section 1345 is subject to contempt proceedings in the event of a violation of such injunction. United States v. Smith, 502 F.Supp.2d 852 (D.Minn. 2007) (defendant found guilty of criminal contempt for withdrawing money from a bank account that had been frozen under 18 U.S.C. ? 1345 and placed under a receivership).

If the defendant prevails in an action filed by the government under the Section 1345, the defendant may be entitled to attorney's fees and costs under the Equal Access to Justice Act (EAJA). United States v. Cacho-Bonilla, 206 F.Supp.2d 204 (D.P.R. 2002). EAJA allows a court to award costs, fees and other expenses to a prevailing private party in litigation against the United States unless the court finds that the government's position was "substantially justified." 28 U.S.C. ? 2412(d)(1)(A). In order to be eligible for a fee award under the EAJA, the defendant must establish (1) that it is the prevailing party; (2) that the government's position was not substantially justified; and (3) that no special circumstances make an award unjust; and the fee application must be submitted to the court, supported by an itemized statement, within 30 days of the final judgment. Cacho-Bonilla, supra.

Healthcare fraud attorneys, bank and mortgage fraud law firms, and securities fraud lawyers should be cognizant of the government's authority under the Fraud Injunction Statute. The federal government's ability to file a civil action to enjoin the commission or imminent commission of federal health care fraud offenses, bank fraud offenses, securities fraud offenses, and other offenses under Chapter 63 of Title 18 of the United States Code, and to freeze a defendant's assets can dramatically change the course of a case. While Section 1345 has been infrequently used by the federal government in the past, there is a growing recognition by federal prosecutors that prosecutions involving healthcare, bank-mortgage and securities offenses can be more effective when an ancillary action under the Section 1345 is instigated by the government. Education

Free education! That's right nursing centers, retirement homes, nursing homes and even long-term care facilities offer free education given you plan on staying with their company. Most won't offer the education unless you've been with employed with them for a specific amount of time. Some places it takes 3 months, 6 months and some even a year to take advantage of this great benefit. Face it education can be quite expensive so to find an employer that offers it FREE? Pfff can't pass that offer up its too great of a deal.

Training

It only takes 6-10 weeks to become a CAN sometimes even less than that depending on what school you attend. For me personally my training was 3 ? weeks long I had to attend class 2 days a week (pretty simple if you ask me). This allows you to get trained, certified and most of time employed in a short period of time. There are other training facilities that will train in a much shorter amount of time but I will tell you the course load is a little intense they are cram courses.

Benefits

Most CAN positions offer great with benefits sometimes with no benefits. It really depends on who you are employed by. Here is an example for you; when I was a new grad looking for work as a C.N.A all the agencies I applied for offered me $13.00-$16.00/hr... sounds awesome right? Well... it is and it isn't although the pay is good the scheduling wasn't it was an on call position and I was only getting 20 hours per week. Now all agencies are not like this most of them have plenty of jobs for you where you will get at least 40 hours a week but I needed something more stable with benefits even if that meant receiving a 2-3 dollar pay cut. Hospitals and Nursing Homes are also great places to work with good pay and benefits. If you can get a position at a hospital take it because they will cross train you and there is plenty of room to advance. Last but not least there is always the benefit called "Tuition Assistance" especially if you are planning on advancing and becoming an LPN or RN.

Growing Demand

Look at our economic situation people are losing jobs left and right. Baby boomers account for 30-35% of our population. As they age they create a greater need for Health Care Providers specifically Nurses and C.N.A's also called Certified Nurse Aides. So if you sit and really think about it becoming a C.N.A is not only a quick certification to put under your belt but it's also a way to secure your employment/career for the future.

Improved Income

Most C.N.A's make somewhere between $22,000 -$35,000/yr (yes as new grads). You have some that work through agencies sacrificing benefits for pay then you have C.N.A's that advance their skills and become cross trained in other departments/areas of healthcare thus making themselves more valuable which qualifies them for better pay. Your average C.N.A makes $25,000 annually. Granted to some of you this might not be much but for the time spent in school this is a lot better than most dead end jobs such as: Fast food, retail etc

Cost

The cost for this certification will vary from school to school I paid $500.00 for my certification that paid for the class and the books. My scrubs, stethoscope and blood pressure cuff collective cost 50.00 so in total $550. Other schools will charge $600-1500 and most of the time they include everything you need. If you can try not to spend more than $700.00

International Adoption - Is it possible to Triumph from Tragedy

In the early hours of Dec 26th 2004 the Western world awoke to the unfolding horror that we came to know as the Asian Tsunami. Those of us still recovering from obscenely large amounts of food and drink from the previous day sat transfixed as we watched a horror story of biblical proportions unfold before our very eyes.

The United Nations estimated that the Asian Tsunami left more than five million people homeless, including about 1.5 million children most of whom became orphaned. The outpouring of emotion from around the world was of mixed benefit as far as the region was concerned in that yes we all dug deep into our pockets and yes we all lobbied our Politicians to something about it and yes bizarrely this tragedy may have had some knock on effect in the movement to alleviate Third World debt and poverty but the blessings were mixed as far as the people on the ground were concerned.

Since the disaster, adoption agencies around the world have been fielding phone calls from well-meaning families wanting to adopt a child from one of the countries hit.

Adoption experts say the best thing people can do is to donate money to causes that directly help the children. They say it's wrong to take a traumatized child away from the environment that they have grown up in.

"Adoptions, especially inter-country ones, are inappropriate during the emergency phase as children are better placed being cared for by their wider families and the communities they know," said the charity Save the Children in a statement released Jan. 6, 2005.

International Adoption needs to be well planned

"The last thing they need to do is be rushed away to some foreign land," said Cory Barron of Children's Hope International, an American adoption agency. "We have to think of the child first."

Adoption by some well meaning couple in the west flying half way round the world bearing large sums of money to whisk the child away to a life totally alien to everything it has known isn't always what is in the best interests of the child.

It is worth bearing in mind the following facts after any tragedy like this:

o Children will be experiencing an immense sense of loss and grief.

o They will need to know what they feel is normal and that they're not going crazy.

o They need to be with people they know and to feel as safe as possible.

o They need to establish a daily routine as soon as possible to reduce their fears.

o They should play with other children to have time away from their fears and allowed to have creative expression such as materials to draw.

o Those separated from family members need to be registered as soon as possible and reunified quickly.

o Putting children in a temporary care facility or an orphanage should be the last resort.

Around 200 children were orphaned and many more lost one parent when the Tsunami struck the district of Nagappattinam in Tamil Nadu state, the worst-affected region in India.

The local administration has handled scores of queries from individuals and organisations wanting to adopt the children.

But fears of human trafficking have made the government tread with caution. The emphasis now is on rehabilitating these children in the local communities. Suryakala, a district social welfare officer in Nagappattinam, says many children they talked to preferred to remain here rather than move out of the area.

The local administration has asked those interested in adoption to send in applications. But they are in no hurry to move these children out.

Around 60 children have been put up in an orphanage run by the Zion Church in Nagappattinam.

Parvathi lost her parents but has returned to the school to take her examinations. She visits her relatives once a month and says she prefers to stay in Nagappattinam.

Local charities and social activists have lobbied hard with the government not to "give away" these children for adoption. Aftab, a young activist, says he learned a lot from the aftermath of the Gujarat earthquake in 2000.

He says that in the past two months there have been several instances of representatives of organisations trying to "forcibly" take away orphans. Nagappattinam was one of India's worst-hit areas" The local community objected and expressed its willingness to take care of such children," says Aftab. "None of these children want to be moved out," he says.

The local administration, Aftab says, is still not clear about what it wants to do with them.

He has met representatives of different villages who back the idea not to move them out.

"Why should these children be sent to orphanages and homes far from here?" he asks.

Efforts by individuals like Aftab seem to have had an impact.

The local administrator's office has decided against any hasty decision.

One official summed up the dilemma faced by the government: "The issue of children is a delicate matter in any community... one wrong step and we will invite the wrath of the people."

Adoption experts are hoping the outpouring of interest in adoptions from the tsunami disaster might translate into adoptions elsewhere. The real tragedy is that the tsunami doesn't even dent the numbers of orphans worldwide, the real numbers are unfathomable. Most adoption specialists say the number of orphans globally may be somewhere in the range of 40 to 60 million--13 million in sub-Saharan Africa alone due to the AIDS crisis there, and many more in Russia, China and Latin America. Only a fraction of those children are in official adoption pools.

"We are hopeful that the tsunami-affected countries will eventually have an open mind to international adoption," says Thomas Atwood, President of the US National Council for Adoption. "But we're also hopeful that parents will look to adopt children in other parts of the world. There are thousands of children available for adoption right now. For those whose hearts have been tugged by the tsunami, perhaps this is a step in their journey towards another child."

So perhaps even after the darkest and most terrible of tragedies there can be some positive long term benefits and these are that whilst a large number of people may ignore the need or desire to adopt from within their own communities in favour of adoption with an International dimension this raising of the Adoption Profile and the inherent potential problems may well bring some of those new to Adoption back to considering Adoption from within their communities. The other benefit that can be taken from this whole affair may be the overall increase in the awareness of the concept of Adoption itself. If this in turn leads to more children being partnered with Adoptive Families then that can only be considered good.

The Judgment Recovery Business

While there are exceptions, most people make good money enforcing judgments only after studying, working, and learning for years. (Ignore any web sites telling you this is a way to get rich quick or easily.)

The Judgment recovery business is an opportunity for hard working individuals to earn a good living enforcing or finding court money judgments. Like any business, success depends mostly on you, but partly on the economy, your location, and ever-changing laws.

There are two ways to make money on judgments, the first way is to find (preferably enforceable) judgments leads. There are many ways to find and get leads, see my other articles about judgment leads.

The second way to make money is the next step, which is to follow up on leads and successfully enforce the judgments you find. That is what this article is about.

The first part of getting and staying in this business is to get and keep getting education and training. There are many ways to find and get training, see my other articles about judgment training courses.

The second part it to have realistic exceptions, it takes a long time (especially in this economy) to make money enforcing judgments. Plan to start with lots of savings, or another job while you are learning and starting your judgment recovery business. Over time, you will get out of this business what you put into it.

The details and specific methods available to enforce judgments depend on the State and County the debtor's assets are in. The basic method is always the same, you start by buying (take assignment) of the judgment from the Original Judgment Creditor (OJC).

You can buy judgments outright, or buy them on the (far more common) future payment basis, where you pay (an average of 50% of what you recover) to the OJCs after you recover money from the debtor.

Then you find the assets of the debtor, and then either persuade them, annoy them, or shock and awe them to get or take their assets. After enough assets are received or taken to satisfy the judgment, you file a Satisfaction of Judgment with the court. Then (if you did not buy the judgment outright) you pay (e.g. 50%) to the OJC.

If you are not a lawyer or a collection agency, the only way you can enforce someone else's judgment is if you legally full take ownership (assignment) of the judgment, by having the original judgment creditor assign (having their signature notarized) the judgment to you, the Judgment Enforcer. This means you own it and in court or in any other legal context concerning the judgment, you can step "into the shoes" of the OJC.

One mistake nearly all judgment enforcers make is to take almost every judgment that comes their way. Over time all judgment enforcers learn to screen judgments carefully, and not take any where the debtor has no assets, or the debtor is too far away. Experienced judgment enforcers refer enforceable judgments to other enforcers or judgment companies.

Once you have a debtor with assets, and the right to seize those assets, you can start to do the things that can lead to assets. It is your job to find and take assets. Some of the things you can do is look at the debtor's credit reports, conduct investigations, bringing the debtor and people that owe your debtor money, back into court for extensive repeated examinations, seizing property, putting liens on homes, garnishing wages, etc.

Compared to other businesses, judgment recovery is not an expensive business to start or keep running. You need a computer, a web site, email, a good judgment recovery course, a separate phone line. It can be from your home but you need a separate, secure work space to qualify for the database providers, with a locking file cabinet and a shredder. You need a fax machine or an internet fax solution.

The judgment recovery business is easy to start, and if you study, work, and repeat, you can make money. There are many training courses and resources on the web, some are free or very cheap.
