When Staying At Home Is No Longer An Option

Let's call it like it is- most people don't like to move and most older individuals certainly do not want to leave the family home and move into an assisted living environment. There are of course many reasons that make a move so difficult, not least of which, is the overwhelming thought of emptying cupboards, basements and bedrooms. When the 'home' is no longer safe- is usually the determining factor of when a move should be made. But sometimes it is hard to determine when a move to a higher level of care is appropriate. For older couples it is sometimes advisable to plan a move while the couple is still well enough to adjust to a new setting. However many will only consider a move after a spouse dies.

Once it has been decided that a move is necessary, there are several options to consider. Most seniors strongly resist moving into an "old folk's home" for fear of the negative images they hold. There are several options available in today's marketplace including: condominiums, life lease apartments, senior's apartment buildings, supportive housing, retirement residences, and long term care facilities. An open discussion about what the senior would like and their current and future care needs is a great place to start.

Like the condominium, however, the largest drawback to this type of facility is the need to move again to higher levels of care when health begins to decline and the need for assistance with tasks of daily living increase unless there is space and interest in hiring private home support assistance and/or a live in caregiver.

Supportive housing provides affordable housing designed to help seniors re-establish connections to the community. The housing is linked to voluntary and flexible support services designed to meet the seniors' needs and preferences. It is designed for people who only need minimal to moderate care, such as homemaking or personal care and support, to live independently. The level of support may vary, and some support services are provided by on-site staff, while in other instances may be delivered on an outreach basis. This may include adult day programs or medical/physiotherapy clinics coming into the apartment building. Staff working in these facilities try to help seniors in their building get linked into other services offered out in their community, such as senior's centres. These staff, however are not medically trained, some are Personal Support Workers (PSW's) while others have certifications in recreation planning. In many facilities, no one is on staff during the night in case of emergency. Supportive housing buildings are owned and operated by municipal governments or non-profit groups including faith groups, seniors' organizations, service clubs, and cultural groups. Accommodations, on-site services, costs, and the availability of government subsidies vary with each building.

Accommodation costs are based on market rent for similar apartments. Seniors wishing to live in this environment need not have a certain income level however subsidies are available for seniors with limited financial means. If eligible, the government may subsidize the rent so that the senior only pays up to 30% of their household's monthly income. To be eligible for a rent subsidy, the senior must be a Canadian citizen, landed immigrant or refugee claimant. If they own their home they are obliged to sell it within six months of moving into supportive housing. Local governments may set additional eligibility requirements for rent subsidies. There is usually a waiting list for subsidized units. Seniors may have to pay an additional fee for optional services such as transportation, recreational outings or hairdressing.

To find out what the further eligibility requirements for subsidy are for your province, and to find out where there is a supportive housing unit in your area, contact your local CCAC or Community Care Association who have application information as well as a listing of all supportive housing locations in the area.

A retirement residence is another option. Many are geared to modestly well and independent seniors. These rental facilities, can range in price and service delivery. Many offer dining room settings, pools, exercise rooms, supervised outings and bus services. Units can include a bachelor, one or two bedrooms and some have kitchenettes that allow residents to opt in or out of some of the meals. These retirement residences have the benefit of having staff (typically Personal Support Workers) available to residents as well as nursing and recreation planning staff. This provides the senior and their family a feeling of security in knowing that there is always someone close by in case of emergency. These facilities often become a community unto themselves, with meals offered and activities and events pre-organized by the staff. Many even have visiting physicians and other health practitioners and can arrange for medications to be delivered right to the resident's door.

Within many retirement communities varying levels of assistance for personal care are available (assisted living) and can be purchased as needed for an additional fee. These programs are offered as a means to help seniors 'age in place' so another move will not be necessary. Additional levels of care may be referred to as 'assisted living' which includes some hands on assistance from a Personal Support Worker for bathing and/or dressing and may include medication monitoring. If the individual requires more assistance during the day and evening, or are dealing with significant cognitive issues that result in the need for full time supervision or a secured floor, while some facilities may be able to accommodate others would deem them ready to move to long term care or to require extra help from private service providers.

A life lease apartment is much like a condo - but includes access to all the services of the retirement home. These facilities may be within a retirement residence or a separate facility. The benefit to these types of apartments is that the resident maintains a bit of equity -they own their apartment and when they pass away, the money from the sale of the apartment will act as an inheritance or be available to pay off any remaining debt. If a retirement residence has life lease suites along with apartments, assisted living programs and long term care, the senior could move once and not need to move to another facility. Rather, they would move within the facility as the need arose for higher care levels.

One of the major drawbacks to moving to a retirement setting is the need to adjust to a communal setting. In these facilities there is a set menu, a set meal time and bus trips and outings are set according to a pre planned schedule. It can also be a shock for a senior first moving into one of these facilities to see "all the old people". Discussing what to expect and getting tours of possible residences will help make the decision as to whether the facility will be a right fit. Some locations will offer trial stays so that seniors can see what daily life will be like, get to taste the food and meet other people who live there. Respite and convalescent care is also offered in many retirement residences and may be another good way to introduce an alternate setting.

A long term care facility is available for those who require more assistance than what is offered by the retirement residence. These facilities are funded by the government so that no person who requires this level of care will be turned away for lack of funds.

These facilities have 24 hour nursing care and residents receive help with all activities of daily living- eating, dressing, bathing, grooming, as well as having provision for laundry and housekeeping.

In the Province of Ontario, long term care facility admission is accessed through the Community Care Access Centre (CCAC). The CCAC will send a case manager to your home to help you to select 3 facilities that you would be willing to move to, in order of preference. Much like Ontario, British Columbia, Alberta, Quebec and Prince Edward Island have agencies (Home and Community Care Services, Community Care Access Capital Health, "Centres locaux de services communautaires"(CLSC) (Local Community Services Centre in English) and Home Care Office respectively) through whom residents of the Province access admission to long term care. These government agencies assess applicants for eligibility, assist with completing applications, monitor the waiting lists, and advise residents of their admittance to a particular home. Initial contact with any of these agencies can be completed by either the senior themselves or a family member. To ensure that you make an informed choice, it is always good to book a tour of each facility, enjoy a lunch and speak with other residents and family members prior to making any decisions on your application.

Credit Repair Adventures - A True Story

Cease Communication Letters Cut Two Ways

Bob and Sue were reading about credit repair and the Fair Debt Collection Practices Act on the internet. They came across information about Cease Communication Letters which would force a collector to stop calling. So one day, after getting a call from an aggressive collector, Sue suggested they send a Cease Communication Letter. They sat down at the keyboard and gleefully wrote a note to the collector demanding that he cease communication. Bob even added some impressive language to convey his knowledge of the law. They went to the Post Office, mailed the letter, and went out to celebrate their credit repair victory. And then it all went bad.

The Cease Communication Backlash

Bob and Sue thought they magically made the collector vanish. Unfortunately, the collection was about to return with a vengeance. One evening there was a knock on the door. When Bob answered a man handed him an envelope. Bob had been served. The collector who received the Cease Communication Letter had returned the collection to the original creditor. The collection was well within the statute of limitation for collecting through the courts, and the creditor decided to sue. It was their right. Bob and Sue learned the hard way about sending Cease Communication Letters before the expiration of the Stature of Limitation. Credit repair decisions require care.

Falling for a Collection Trick

One day Bob and Sue got a friendly letter from a collection agency. It was an offer to settle an old debt for half price. Even better, Bob and Sue could make three affordable installment payments. They were determined to make their credit repair program succeed, so they called the collector and started the payment plan. It was only later that they realized the mistake. First of all, the collection was many years past the statute of limitation for collection through the courts. Worse yet, in spite of the fact that this account was showing on their credit report, the original default had occurred more than seven years ago...

Credit Repair and Timing

So what did this all mean? It meant that they did not have to pay a penny. The fact that the collection was beyond the statute of limitation for collecting through the courts meant that the collector had no way to enforce the collection. And the fact that the original default date was over seven years old meant that Bob and Sue could have disputed the presence of the account on their credit report with the credit bureaus and it would have been deleted. Credit repair is all about the timing.

Statute of Limitation Knowledge Pays Off

Sometime later, after Bob and Sue had become aware of their credit repair rights, another collection letter arrived. They were not about to be fooled again. First, Bob checked the statute of limitation and found that the original default happened about ten years previously. He had also learned about his right to validate a debt within thirty days of getting a collection letter. So he sent a letter demanding that the collector furnish proof of their legal right to collect the debt along with a true accounting of the amount claimed. Because he knew that the documentation must be objective he also insisted that the account come from the original creditor. The collector was never heard from again. The collection was never reported on Bob's credit. Credit repair success is sweet.

Credit Repair and New Accounts

Bob and Sue's credit repair effort was well underway. Their credit reports were really shaping up. Many derogatory accounts had been deleted. They were happy, at least until their trip to the car dealer. The finance manager ran their credit and informed them that their credit scores were too low. The reports were not bad, but the scores were dismal. After doing a little homework Bob and Sue found out about the importance of building new credit. It is not enough to clean up derogatory information. The FICO credit scoring model needs open and active credit. So they each opened two new secured credit cards. They made their payments on time and kept the balances under 20% of the high credit limit. Within a few months their scores were dramatically higher. Soon they were behind the wheel of their new car.

Bob and Sue were thrilled; their credit repair effort was successful, but they worried about a setback. They wanted to be ready for anything. So they sat down one Sunday morning and worked up a budget. When they were done they had found a way to set aside ten percent of their monthly income for a savings account. Adoption - The Ultimate In Red Tape

An associate of mine finds it very interesting that any couple in this world, no matter how rich or poor, no matter what they do for a living, no matter if they have a criminal record or not, no matter what kind of persons they are, can have as many kids as they like and nobody can say one word about it.

But when a middle class, hard working, law abiding couple wants to adopt a child they have to jump through more hoops than a clown at a three ring circus. He wonders why.

In this article we'll try to explain some of the problems and red tape associated with a couple trying to adopt a child.

For starters, adoption law varies from state to state. Yes, there are laws, and depending on where you live those laws can be quite different but there are some laws that are pretty common across the board. There is the Consent to Adoption. This consent refers to the agreement by a parent, or a person or agency acting in place of a parent, to relinquish the child for adoption and to release all rights and duties with respect to that child. In other words before you can adopt the child the birth parent or agency in charge, if the birth parents are dead, has to give consent for the adoption to take place.

Then there is the parties to adoption. In order for an adoption to take place, a person available to be adopted must be placed in the home of a person or persons eligible to adopt. All States, the District of Columbia, and the US territories Guam, Puerto Rico, American Samoa, the Northern Mariana Islands, and the Virgin Islands have laws that specify which persons are eligible as adopting parents, and which persons can be adopted. In other words they decide whether or not they think the adoptive parents are fit and this varies from state to state.

So who CAN adopt? Generally speaking anyone over the age of 18 but in some states 21 and still in others the minimum age is 25. Again, this is all state regulated. There are some states that allow minors to adopt under certain circumstances but this is very rare. In some states the adopting parents must be at least 10 years older than the child. So if you want to adopt a 15 year old boy you have to be at least 25 years of age. Then there is the residency question. Most states require that you be living at your current residence for at least 60 days.

So who can BE adopted? Generally, anyone under the age of 18. Of course depending on the state there are some additional requirements. For example, in some states the child has to be living in that state at the time of the adoption. So if you wanted to adopt someone from overseas you wouldn't be able to. In some states this extends further to the child having to be a resident for a certain length of time. Some states do allow the adoption of a person regardless of age but this is very rare.

Then there is the question of WHO can place a child for adoption. This is usually the birth parent or parents unless both are dead and then it is the agency to which custody of the child was appointed.

But this gets even more complicated. What if the birth mother and father are not married and the mother wants to put the child up for adoption but the father does not? This becomes an extremely messy situation. First there is the court battle between the mother and father to determine who gets the say in the matter. In most cases unless the mother is proven unfit the right to place the child up for adoption is granted. If not, however, then a determination has to be made as to whether or not the father is given custody of the child. We are assuming at this point that since he was against the adoption that he will want to keep the child, but he is in no way legally obligated to do this and can put the child up for adoption at a later date.

Then there are the adoption fees. In most states the adoptive parents have to pay these fees and they can be enormous, going into the tens of thousands of dollars. My associate thinks this is absurd. The parents don't want the child but it's the adoptive parents who have to pay to get the child even though the child isn't wanted. Some would say that is hard logic to argue with. As you can see, adoption is not simple. Add to all the above that the adoption process can be a very lengthy one, sometimes taking years, it makes you wonder why anyone would go through the trouble. For that matter why would someone have to when there are so many unwanted children in the world?
